1. About these terms

These terms apply to your use of the Performance Metrics ApS website. They do not govern the use of Performance Metrics ApS products, applications, platform, support services or other customer deliverables, which are governed by a separate agreement between the Customer and Performance Metrics ApS.

By using the website, you accept these terms. If you do not agree with them, you should not use the website.

2. About Performance Metrics

Performance Metrics provides applications and a platform that extend Microsoft Teams Phone and make it easier to administer, understand and use professionally. Performance Metrics does not provide the telephony service itself, the call infrastructure or the Teams Phone licence; these are provided by Microsoft and/or your own supplier.

3. Use of the website

The website may only be used for lawful purposes. You must not:

• attempt to gain unauthorised access to the website, servers or associated systems;
• disrupt or place an unreasonable load on the normal operation of the website; or
• reproduce, copy or resell website content without prior written consent.

4. Intellectual property rights

All website content—including text, graphics, logos, product names (including DDI Manager, VoiceQ365 and Wito Attendant), design and software—belongs to Performance Metrics ApS or its licensors and is protected by applicable intellectual property law. No rights are transferred through use of the website.

5. Products and services

Descriptions of products and services on the website are for guidance only and do not constitute a binding offer. The specific deliverables, functionality, prices, support, service levels, data processing and other terms are defined in a separate agreement between the Customer and Performance Metrics ApS.

In the event of any inconsistency, the separate customer agreement and its appendices take precedence over information on the website and these Website Terms.

6. Third-party services

Information on the website may refer to Microsoft Teams, Microsoft Teams Phone or other third-party services. Performance Metrics ApS is not responsible for the availability, functionality or terms of Microsoft or other third-party services, unless expressly stated otherwise in a separate customer agreement.

7. Disclaimer

The website and its content are provided “as is”. Performance Metrics ApS aims to keep the content accurate and current but does not warrant that the website will always be error-free, available or uninterrupted.

8. Limitation of liability

To the extent permitted under Danish law, Performance Metrics ApS is not liable for indirect or consequential loss, including operational loss, loss of profit, loss of data or loss resulting from lack of access to the website.

This limitation applies only to use of the website and does not limit any liability, rights or obligations arising from a separate customer agreement.

The processing of personal data is described in our Privacy Policy and Cookie Policy.

10. Changes to these terms

Performance Metrics ApS may change these Website Terms at any time. The current version will be published on this page with the date of the latest update. Changes to these Website Terms do not affect existing customer agreements unless the relevant agreement provides otherwise or the Customer accepts the change.

11. Governing law and jurisdiction

These terms are governed by Danish law, excluding rules that would lead to the application of another jurisdiction's law. Disputes arising from or relating to these terms will be decided by the Danish courts, with the Copenhagen City Court as the agreed venue, unless mandatory law provides otherwise.
